Pergo Wins First Ruling Article Number: 72
| | Raleigh,
NC, Nov. 2—An Administrative Law Judge (ALJ) with the U.S. International Trade
Commission (ITC) issued an initial determination that Pergo’s glueless click
laminate product, and the installation instructions for that product, do not
infringe on patents held by Välinge Aluminum. Pergo’s license for the product
is jointly held by the Belgian firm Unilin.
A final decision from the ITC is expected at the latest February 5. If the ITC
upholds the ALJ’s ruling, Pergo will be allowed to continue importing the
product with the existing installation instructions.
The ITC began its investigation last December 29 in response to a complaint
filed on behalf of Alloc Inc., Berry Finance, and Välinge Aluminum.
